Our Practice Areas
PIP stands for personal injury protection. In Florida, every car owner must carry a minimum of $10,000.00 in personal injury protection coverage, and $10,000.00 in property damage coverage.
Florida is a “no fault” insurance state. This means that when you are in an auto accident, your medical bills are paid from your own auto insurance, regardless of who is at fault, up to the maximum limit of $10,000.00. PIP may cover up to $10,000.00 of your medical bills, 60% of your lost wages, or $5,000.00 in death benefits.
PIP covers the vehicle’s owner and extends coverage to the vehicle owner’s family members with whom he or she resides. This can include children and other household members, provided that the resident family member does not own their own separate vehicle. Passengers in the vehicle may also be covered by the policy, provided the passenger does not own a vehicle of their own.
After the accident, we will represent you both for your bodily injury claim and your property damage claim. We will coordinate your property damage claim with the third-party insurance company and ensure that a written estimate is quickly prepared. We will also coordinate a vehicle rental for you, so that you can focus on your recovery, and getting back to your daily routine as soon as possible.
No, you are not automatically entitled to this. The insured, or person qualifying for coverage under the insured’s policy, must first seek treatment with a qualified medical provider within 14 days after the accident in order to be eligible for any PIP benefits. Failure to seek treatment with a qualified medical professional within the 14 day time limit may result in being ineligible to receive any benefits. In addition, upon receiving treatment by a qualified medical provider within the 14 day time frame, benefits will be limited to $2,500.00, unless it is a medical emergency. In order to be eligible to receive the entire $10,000.00 of medical benefits, a qualified medical professional must first determine that the injured party has suffered an emergency medical condition. However, if it is determined that no emergency medical condition existed, then benefits will be limited to $2,500.00
According to Florida Statute 627.732, an emergency medical condition is defined as a medical condition which manifests itself in acute symptoms of sufficient severity, which may include severe pain, such that the absence of immediate medical attention would reasonably be expected to result in any of the following:
1. Serious jeopardy to patient health
2. Serious impairment of bodily function
3. Serious dysfunction of any bodily organ or part.
Bodily injury covers serious injury and or death caused by another person’s negligence when when operating a motor vehicle. Bodily injury coverage will protect you and members of your family from mounting medical bills, pain and suffering, wage loss, and other damages caused by the negligence of another person. Florida law does not require that bodily injury coverage be purchased.
This type of coverage protects an individual when he or she is affected by the vehicular negligence of another party, and that other party does not have any bodily injury coverage, or does not maintain enough bodily injury coverage for the damages they caused.
