Am I automatically entitled to the full $10,000 in medical coverage?

No, you are not automatically entitled to this benefit. The insured, or person qualifying for coverage under the insured’s policy, must first seek treatment with a qualified medical provider within 14 days after the accident in order to be eligible for any PIP benefits.

Failure to seek treatment with a qualified medical professional within the 14 day time limit may result in being ineligible to receive any benefits. In addition, upon receiving treatment by a qualified medical provider within the 14 day time frame, benefits will be limited to $2,500, unless the person’s injury is determined to be a medical emergency, also known as an emergency medical condition determination.

In order to be eligible to receive the entire $10,000 of medical benefits, a qualified medical professional must first determine that the injured party has suffered an emergency medical condition. However, if no emergency medical condition determination is affirmatively made or the emergency medical decision is not clearly stated, then, benefits will be limited to $2,500.
